The Senate may have voted down the so-called "Fairness Doctrine" 87-11 today, but they passed 57-41 the Durbin Amendment that specifically states as its purpose:
"To encourage and promote diversity in communication media ownership, and to ensure that the public airwaves are used in the public interest."
So who decides what is in the public interest and what's not?

The vote was straight down party lines. All democrats yea (except Kennedy who wasn't there), all republicans nay.
